For a foreigner this is stressful: the papers are in Thai, the date is close and it is not clear whether you are a witness or the accused. The first hour matters most: check that the summons is real, understand your role and find a lawyer if you need one.<\/p>\n\n\n\n<p class=\"lead wp-block-paragraph\">Below: how to check a court summons, what your role may be, what happens if you do not appear and what to prepare. We are not a law firm: in court, you are represented by a licensed Thai lawyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In short<\/h2>\n\n\n\n<ul class=\"wp-block-list glance\"><li><strong>Check that the summons is real.<\/strong> Scammers often pretend to be the police or a court and ask for money.<\/li><li><strong>Find out your role:<\/strong> witness, defendant in a criminal case or party in a civil case.<\/li><li><strong>Do not ignore a real summons.<\/strong> Not appearing can lead to a warrant or a judgment against you.<\/li><li><strong>A defendant needs a licensed Thai lawyer.<\/strong> Preparation before the hearing matters most.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">First: check that it is real<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Fake calls and messages in the name of the police, the court or DSI are a common scam in Thailand. A real court will never ask you to transfer money to \u201ccheck\u201d your account or to avoid arrest.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A real court summons is a paper document with the court\u2019s name, a case number and a date<\/li><li>Find the court\u2019s phone number yourself, on its official website, not in the message<\/li><li>Never transfer money or share bank codes to anyone who calls about a case<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-video\"><video controls preload=\"metadata\" src=\"https:\/\/www.unblockpro.asia\/wp-content\/uploads\/2026\/05\/11.-What-to-do-if-you-are-called-to-court_2.mp4\"><\/video><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">What your role may be<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Witness.<\/strong> You are asked to tell the court what you know, for example about a transfer that went through your account.<\/li><li><strong>Defendant in a criminal case.<\/strong> The prosecutor accuses you of an offence. You need a lawyer, and you may need bail.<\/li><li><strong>Party in a civil case.<\/strong> Someone claims money from you, or you claim money from them, for example after a disputed transfer.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In financial cases, a court case often follows a police case: a frozen account, a complaint about a transfer or a fraud investigation. <a href=\"\/en\/how-to-unlock-a-thai-bank-account-blocked-by-cyber-police\/\">Account blocked by the cyber police<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What happens if you do not appear<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li>A witness or defendant who ignores a summons may face an arrest warrant<\/li><li>In a civil case, the court may decide without you<\/li><li>A warrant can create problems at immigration and when you leave Thailand<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you cannot come on the date, a lawyer can ask the court to postpone the hearing for a valid reason.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to prepare<\/h2>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>The summons and any police documents,<\/strong> translated so you understand them.<\/li><li><strong>Passport and visa.<\/strong><\/li><li><strong>Documents about the case:<\/strong> bank statements, transaction history, contracts, chats.<\/li><li><strong>A clear timeline<\/strong> of what happened, in Thai and English.<\/li><li><strong>A licensed Thai lawyer,<\/strong> if you are a defendant or a party in a civil case.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Foreigners who do not understand Thai can have an interpreter in court. Make sure you understand every document before you sign it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Common mistakes<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li>Paying money to a caller who claims to be from the police or a court<\/li><li>Ignoring a real summons because it is in Thai<\/li><li>Going to court without a lawyer as a defendant<\/li><li>Signing documents you do not understand<\/li><li>Leaving Thailand without checking whether there is an open case<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">A typical situation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After a frozen-account case, a client receives a court document in Thai and thinks it is a formality. A translation shows that he is called as a witness in a fraud case linked to a transfer he received. With the documents and his bank records prepared, he gives evidence calmly and the matter does not turn against him. Many people are called as witnesses. As a witness, a lawyer is not always necessary, but preparation is.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can I leave Thailand if I have a court case?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It depends on the case. A defendant may be under bail conditions or a travel restriction.
